Agreeing to these terms
These terms apply to the CoachED Cricket website at coachedcricket.com and every online service offered through it, including courses, certifications, memberships, the members' area and billing ("online services"). The online services are owned and operated by GTech Sports (Pty) Ltd ("CoachED Cricket", "we", "us").
In terms of section 11 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA), these terms are binding on everyone who uses the online services. By using them you agree to these terms. If you don't agree, please stop using the online services.
The Disclaimer and Limitation of liability sections limit our responsibility and may involve some risk for you. Please read them carefully.
Definitions
- "CoachED Cricket website" means the website at coachedcricket.com, including any page, part or element of it.
- "Online services" means the website and any other service we offer electronically, including courses, certifications, memberships, the members' area, billing and email, and the content exchanged as part of them.
- "User", "you" or "your" means anyone who visits or uses the online services, even if they only visit the home page.
Disclaimer
We make every reasonable effort to keep the online services working and their content accurate, but to the full extent the law allows we don't guarantee that they will be available, accurate, uninterrupted, complete, secure or error free, or that they will meet your requirements. You use the online services at your own risk.
CoachED certifications and levels are CoachED's own. They don't represent the coaching criteria of any national or international governing body. Course content is for general information and coaching education.
Limitation of liability
We are not liable to you or anyone else for any damage, loss, liability, cost or expense (direct, indirect or consequential) arising from a breach of these terms by you, or from the failure or delay of the online services or your use of them, except where caused by our gross negligence or intentional misconduct. You indemnify us accordingly.
We are not liable for failing to perform any obligation because of technical problems, an act of God, government action, the failure of a supplier or sub-contractor, industrial action, or anything else beyond our reasonable control.
Nothing in these terms limits rights you have under the Consumer Protection Act 68 of 2008 or other consumer law that cannot be excluded.
Using the online services
You may use the online services only for lawful purposes. You must not:
- share your account, or your course content, videos, examinations or other members' work, with anyone else;
- copy, record, resell or republish course content without our written permission;
- post or send anything unlawful, hateful, offensive, threatening, defamatory or in breach of anyone's rights;
- use robots, scrapers or similar tools to copy content from the online services (search engines excepted);
- frame the online services, or add the names and contact details shown on them to a marketing database.
You may quote small, reasonable extracts if you put them in quotation marks and name CoachED Cricket as the source.
If you break these rules we may suspend or close your account, claim damages and, where appropriate, involve the authorities. Permissions we give are non-exclusive and may be withdrawn at any time.
Your account and password
You are responsible for keeping your password (and any two-step sign-in codes) safe and for everything done with your account. Accounts are personal: one person per account. If you think someone else has used your account, change your password and contact us straight away.
Courses, certificates and membership
Course access, examinations, assignments and certificates work as described on each course page when you buy or apply. Level 3 and Level 4 places are offered through an application and are secured by payment, as described on the application pages.
We may update course content to keep it current. We may refuse or cancel a course place or membership, in which case our Refund policy applies.
A certificate is issued when you meet the course's requirements. We may withdraw a certificate obtained by cheating or by breaking these terms.
Payments
Prices are shown on the site and at checkout, in the currency shown there. Payments are processed by Stripe on its secure checkout; your card details are entered with Stripe and are never stored by us. Subscriptions renew automatically until you cancel them. See our Refund policy for cancellations and refunds.
Intellectual property
All content and intellectual property on the online services, including course material, videos, text, graphics, logos, trademarks, software and databases, belongs to or is licensed to CoachED Cricket and is protected by law. All rights not expressly given to you in these terms are reserved.
Privacy
How we collect and use your personal information is explained in our Privacy and cookies policy.
Equipment and internet access
You are responsible for the device, software and internet connection you need to use the online services. A free account lets you check that the site works on your device before you pay.
Links to other sites
The online services may link to sites we don't control. We aren't responsible for their content or services, and a link isn't an endorsement. You use them at your own risk.
